JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-09-2016 Heard learned counsels for the petitioners and the State. The petitioners being the cousins, cousins' wife, brother, brother's wife, mother and aunt of the husband of the complainant are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 323 and 149 of the Indian Penal Code.
The basic accusation is of torture.
It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.39310 of 2016 (2) dt.08-09-2016 2/2 that the petitioners claim to be separate from the husband of the complainant. Thrust of accusation is against the husband of the complainant. Initially the cognizance was taken only against the husband and father-in-law of the complainant but the complainant challenged the cognizance order in revision and in pursuance to the revisional order, the cognizance has also been taken against other family members including the petitioners. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Madhepura in connection with Complaint Case No. 937 of 2011, subject to the conditions as laid down under Section 438(2) Cr.P.C.
