JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 467, 468, 471, 472 and 420 of the Indian Penal Code.
The prosecution case is that the petitioner got appointed as a Block Teacher in the Middle school, Kukudha on the basis of forged B.Ed. certificate.
It is submitted by learned counsel for the petitioner that the petitioner has resigned from service on 03.05.2013 and amnesty to the effect of not initiating any proceeding was granted by Division Bench of this Court vide order dated 22.06.2015 passed in CWJC No.15459/2014. Statement to that effect has been
Patna High Court Cr.Misc. No.55651 of 2015 (2) dt.08-12-2015 2/2 made in para 10 of the petition which reads as follows:- "That it is submitted that the petitioner has already resigned his service on 03.05.2013."
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar in connection with Itarhi P.S. Case No. 222 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
