JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 The petitioner seeks regular bail in connection with Kathaiya P.S. Case No. 34 of 2019, registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of Bihar Excise Prohibition Act, 2016. Allegation is of recovery of 60 litres of toddy. It has been submitted on behalf of the petitioner that recovery is from the chowk and he has falsely been implicated in this case and he has no criminal antecedent and he has been in judicial custody since 02.03.2019 and now chargesheet has been submitted and there is no likelihood of tampering with the evidence.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on

Patna High Court CR. MISC. No.30469 of 2019(2) dt.23-05-2019 2/2 furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Judge (Exise), Muzaffapur, in connection with Kathaiya P.S. Case No. 34 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
