The petitioner apprehends his arrest in connection with Rahui P.S. Case No. 281 of 2017, registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.
Allegedly, 11 gota of Sisam wood valuing Rs. 85,000/- were stolen away from the market of the informant and on confidential information the informant came to know that Bogda Pawan with the aid and assistance of Sube Paswan and the petitioner have stolen the said sisam wood and have kept at the saw machine of Suraj Sharma, from where the said Sisam wood were recovered by the police.
Patna High Court Cr.Misc. No.24476 of 2018(2) dt.26-04-2018 2/2 Submission is of false implication and that there is no cogent and legal material against the petitioner, only on suspicion he has been implicated in this case, no one has seen the petitioner committing theft of the said wood. The petitioner has got no criminal antecedent and, as such, he deserves sympathetic consideration.
The learned A.P.P. fairly submits that on confidential information the petitioner has been named. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Rahui P.S. Case No. 281 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
