2. The petitioner apprehends his arrest in connection with Naugachia Mahila P.S. Case No. 46 of 2024, registered for the offences punishable under Sections 85, 115(2), 126(2), 352, 351(2)(3), 3(5) of the BNS, 2023 and Sections 3⁄4 of the Dowry Prohibition Act.

3. It is a case of matrimonial dispute.

4. Vide order dated 20.08.2025, the matter was referred to the Patna High Court Mediation and Conciliation Centre for exploring the possibility of amicable settlement of the dispute between the parties.

5. It has jointly been submitted that the mediation has

Patna High Court CR. MISC. No.26663 of 2025(4) dt.08-10-2025 2/3 become successful. The terms and conditions of the compromise entered into between the parties has been annexed with the mediation report dated 19.09.2025.

6. Learned counsel for the petitioner handed over a demand draft of Rs. 6,00,000/- to opposite party no. 2 who is present in the Court and she received the demand draft vide Bank Draft of IDFC FIRST Bank bearing No. 049424, amounting to Rs. 6,00,000/- in favour of Sanam Bharti. The copy of the bank draft is annexed with the record as token of receipt.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Naugachia at Bhagalpur in connection with Naugachia Mahila P.S. Case No. 46 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.

8. If either of the parties retracts from the terms and conditions of compromise, the learned court below may pass appropriate orders.

9. As the petitioner apprehends maltreatment at the hands of the family members of the opposite parties,

Case No. 46 of 2024 is transferred from the Court of SDJM, Naugachia to any other court of competent jurisdiction at Bhagalpur, as assigned by the Principal District and Sessions Judge, Bhagalpur.

10. Let a copy of this order be sent to the Principal District Judge, Bhagalpur.
