This application for anticipatory bail arises out of Complaint Case No. 475 of 2012, Tr. No. 326 of 2016 disclosing offences under Section 406 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act. Considering the fact that there is allegation of dishonour of cheque of a sum of Rs. 2,00,000/- issued by the petitioner in favour of the complainant, who was admittedly an employee, I do not feel inclined to entertain this application for grant of anticipatory bail.

This application is, accordingly, rejected.

The petitioner is directed to surrender before the Court

Patna High Court Cr.Misc. No.44167 of 2017(3) dt.19-12-2017 2/2 below within four weeks from today and seek his regular bail, if so advised. If he does so, his application for grant of regular bail shall be considered on its own merit without being prejudiced by rejection of the present anticipatory bail application by this Court.
