Petitioner is apprehending his arrest in connection with Mahila P.S. Naugachhia Case No.60 of 2018 , registered for offences punishable under Sections 498(A), 341, 323, 504, 506, 34 of the Indian Penal Code and Section 3⁄4 of the D.P.Act. As per FIR, petitioner happens to be husband of the informant and there is allegation of demand and torture. Submission of the learned counsel for the petitioner is that he is still ready to keep her and the matter was referred to the Mediation Centre after appearance of the O.P.no.2. On the other hand the learned counsel for the O.P.no.2

Patna High Court CR. MISC. No.24782 of 2019(5) dt.17-10-2019 2/3 has submitted that she is still ready to reside with the petitioner and stated so before the mediator but the petitioner was not ready to keep her.

Heard learned A.P.P. also.

Having heard both sides and in view of stands of the parties and as the matter relates to matrimonial dispute, this application is disposed of with direction to the petitioner to surrender on 7.11.2019 and on that day O.P.no.2 shall also remain present in the learned court below and on appearance of both the parties, the petitioner shall be released on provisional bail in connection with Mahila P.S. Naugachhia Case No.60 of 2018 dated 6.10.2018, for a period of six months and during that period both the parties have to appear before the learned court below in the fourth week of each month so that he may watch conduct of both the parties and their matrimonial relationship and once being satisfied with the conduct of both the parties especially the conduct of the petitioner, the bail bond of the petitioner shall be confirmed, otherwise the learned court below will pass any other order or orders as he deems fit and proper including cancelling of the bail bond of the petitioner.
