The petitioner is the husband who apprehends his arrest in connection with Gopalpur P.S. Case No. 117/2019 registered for the offences punishable under Sections 342/323/ 498A/34 of the Indian Penal Code and Sections 3⁄4 of the D.P. Act.
As per the prosecution case, due to non-fulfillment of demand of dowry, all the accused persons including this petitioner tortured and harassed her. Lastly, on 19.07.2019 at about 08:00 P.M. she was severely assaulted by means of fists and slaps and the petitioner tried to set her on fire by
Patna High Court CR. MISC. No. 27234 of 2020(3) dt.20-01-2021 2/2 sprinkling kerosene oil.
Considering the fact that the specific allegation of demand of dowry and assault is against this petitioner, I am not inclined to grant him bail.
It is, accordingly, rejected.
