JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-09-2023 The present writ petition has been filed seeking the following reliefs:- "1. (i) The respondents be directed to grant benefit of 2nd Assured Career Progression benefits in accordance with Bihar State Employees Service

Patna High Court CWJC No.17945 of 2015(2) dt.21-09-2023 2/3 Conditions (Assured Career Progression Scheme) Rule 2003 in the pay-scale of Rs.10,000-15,200 w.e.f. 01.7.2000 with grade pay of Rs.6,600/- in accordance with the said Rule 2003, on completion of 24 years of service.

(ii) The respondents be directed to grant benefit in accordance with Modified Assured Career Progression Scheme, 2010 w.e.f. 01.1.2009 in the pay-scale of Rs. 15,600-39,100 with grade pay of Rs.7,600/-.

(iii) The order as contained in letter No.8242 dated 07.8.2013 be quashed so far the petitioners are concerned as the same being contrary to aforesaid Rule 2003.

(iv) In the facts and circumstances of the instant case the petitioners be held entitle to cost and, accordingly, the cost be awarded to the petitioners.

(v) The respondents be directed to fix the pay of the petitioners after grant of the said reliefs and revise the pension accordingly."

Considering the nature of relief sought

Patna High Court CWJC No.17945 of 2015(2) dt.21-09-2023 3/3 for in the present writ petition, I deem it fit and proper to grant liberty to the petitioners to approach the respondent authorities for redressal of the aforesaid grievances.

Accordingly, the present writ petition stands disposed off.
