JUSTICE PRABHAT KUMAR JHA ORAL ORDER 25-07-2019 This appeal has already been dismissed on 15.02.2016 due to non-compliance of the order dated 01.02.2016 against Respondent Nos.1, 2, 4, 6, 13 to 15 and against the legal heirs of Respondent No.9.

The plaintiff-respondent filed the suit for declaration of title over the disputed land and for restraining the defendants from settling the lands in favour of other defendants. The suit was decreed. The appeal being Title Appeal No.76 of 1991 was also dismissed. The defendants are appellants. The judgment is inseparable.

In this view of the facts, if the appeal stood dismissed against Respondent Nos.1, 2, 4, 6, 13 to 15 and legal heirs of Respondent No.9, the appeal as a whole has to be dismissed. Accordingly, the appeal is dismissed.
