Mr.Rajive Ranjan Singh For the Respondent/s :
Mr.Dhananjay Kumar Gupta ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 21-02-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.
Heard learned counsel for the petitioner as well as learned counsel for the respondent.
The petitioner is husband of the respondent Smt. Mani Kiran. The petitioner has brought the suit in the Court of Principal Judge, Munger for a decree of divorce under Section 13 (1) (i-a) of the Hindu Marriage Act, 1955.
During the pendency of the suit the respondent filed a petition for maintenance pendente lite under Section 24 of the Hindu Marriage Act. In her petition she has mentioned that she has no source of income and she has to maintain herself as well as her minor daughter aged 3 years.
Patna High Court C.Misc. No.275 of 2021(3) dt.21-02-2022 2/2 The learned court below has been pleased to grant Rs. 3,000/- per month to the respondent as maintenance pendente lite and also granted Rs. 500/- as litigation cost for every date fixed from the date of filing of the petition. The impugned order itself shows that the respondent was working as community coordinator on contract but the period of contract has expired in December, 2019. It appears that the respondent has no source of income and the learned court below has granted a very congenial amount as pendente lite maintenance, as such, in my view, the impugned order need not interference.
Accordingly, the petition is dismissed.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
