The petitioners are apprehending their arrest in connection with Islampur P.S.Case No.453 of 2018 , registered for offences punishable under Sections 147, 149, 341, 323, 504, 325, 307, 379 of the Indian Penal Code.

Prosecution story is that the petitioner and other accused persons came armed with Rifle, country-made Pistol and Lathi and started abusing and on the order of one Chhote Yadav, all the accused persons assaulted by the 'BUT' portion of the rifle, lathi and rod and thereafter the informant was take to the hospital.

Submission of the learned counsel for the petitioners is

Patna High Court CR. MISC. No.26238 of 2019(3) dt.05-07-2019 2/2 that there is case and counter case between the parties and the opinion on the injuries though have been kept reserved but they are not on the vital part of the body.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-3, Hilsa, Nalanda in connection with Islampur P.S.Case No.453 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
