The petitioner apprehends his arrest in Pirpainty P.S. Case No. 29/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act.
The informant named the petitioner along with other accused persons and alleged that Kalan Ansari and Santu Paswan having armed with pistol came and dragged his son towards the orchard. On the order of Md. Chhotu (petitioner), Kalan Ansari fired at his son and his son got fire-arm injuries. Pankaj Kumar Yadav informed the informant about the occurrence. It appears that on the order of the petitioner, Kalan Ansari made firing in which the son of the informant Praveen
Patna High Court Cr.Misc. No.45576 of 2016 (2) dt.24-11-2016 2/2 Kumar got fire-arm injuries.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrenders in the court below, learned court below shall consider the prayer for regular bail of the petitioner on its own merit.
