The petitioner seeks bail in a case registered under Section 370 of the Indian Penal Code.

Allegation is that on 13.02.2018 at 11.30 hours informant's son, namely, Krishna Kumar, aged about 2 1⁄2 years had gone to play, but he did not return. Informant made search, but no trace has been found.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.01.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on disclosure made by co-accused. The

Patna High Court CR. MISC. No.31122 of 2019(2) dt.10-05-2019 2/2 victim boy is said to have already been recovered. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Ara Nawada P.S. case No.29 of 2018.
