The petitioner apprehends his arrest in Sakatpur P.S. case No. 36 of 2017 for the offences punishable under Section 307 and other Sections of the Indian Penal Code.
The informant alleged that the accused persons came, caught her hair and assaulted her. The accused persons also made her naked. It is further alleged that petitioner assaulted the informant with Farsa on her head.
The learned counsel for the petitioner submits that there is a counter version being Sakatpur P.S. case No. 37 of 2017. The informant of the case is wife of the petitioner. The informant, Gauri Devi, got one lacerated wound on her head and the injury is opined to be simple in nature.
Considering the facts that there is a case and counter
Patna High Court Cr.Misc. No.43638 of 2017 (2) dt.20-09-2017 2/2 case and on account of assault made by the petitioner simple injury is caused, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Darbhanga in connection with Sakatpur P.S. case No.36 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
