JUSTICE SANDEEP KUMAR ORAL ORDER 24-05-2023 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Manhar P.S. Case No. 290 of 2022 registered for the offence under Sections 414 of the Indian Penal Code and 25(1-b)a / 26/ 35 of the Arms Act.

The allegation against the petitioner is that during vehicle checking, the petitioner started fleeing away after seeing the police but he was apprehended after chase and one pistol along with cartridge was recovered from his possession. Learned APP for the State has opposed the prayer for bail by contending that the petitioner has criminal antecedents

Patna High Court CR. MISC. No.28609 of 2023(2) dt.24-05-2023 2/2 under Sections 392 and 395 of the Indian Penal Code. Under the facts and circumstances of the case and taking into consideration the criminal antecedents of the petitioner, as mentioned above, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer of bail of the petitioner is rejected herewith.

The District Judge, Patna and the District Judge, Vaishali are directed to expedite the trial of cases filed against the petitioner including the present case.

Let a copy of this order be communicated to the District Judge, Patna and the District Judge, Vaishali through FAX and e-Mail for its compliance forthwith.

If there is no sufficient progress in the trial of the petitioner then the petitioner may renew his prayer of bail. (Sandeep Kumar, J) Vikas/- U
