2. The petitioner has prayed for bail in connection with Hasanpur P.S. Case No. 45 of 2024 registered for the offence punishable under Sections 147, 148, 341, 323, 302, 307 and 504 of the Indian Penal Code.
3. The case of the prosecution is that 12 named accused persons and 5-6 unknown persons variously armed with lethal weapons, surrounded the house of the informant and started assaulting her husband, as a result of which, he fell on the ground. It is also alleged in the FIR that Lalo Sah ordered to kill and on his order, the petitioner along with others assaulted the husband of the informant with an iron rod, khanti and

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. From perusal of the FIR, it is clear that there is no specific allegation against any of the accused persons. Counsel also submits that the nature of allegation is general and omnibus and no weapon is attributed to the petitioner. It has also been submitted that similarly situated other co-accused namely, Deepak Sah has been granted bail by Co-ordinate Bench of this Court in Cr. Misc. No. 66033 of 2024. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Petitioner is languishing in judicial custody since 20.01.2025.
5. Learned counsel for the informant and learned APP for the State have vehemently opposed the prayer of bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned
