Versus

1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Gajendra Kumar Singh For the Opposite Party/s : Mr. Smt. Gulnar Begam ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-08-2017 Heard the parties.

The petitioner is apprehending his arrest in connection with Daraunda M.H. Nagar P.S. Case No. 2 of 2017 registered for offences punishable under Section 392 of the Indian Penal Code.

Allegation against the petitioner, who is not named in the first information report, is that his name transpired later on, on the statement of the daughter of the informant. Submission of the learned counsel for the petitioner is that petitioner has been falsely implicated in this case and had anybody identified him, he would have been named in the first information report.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.36486 of 2017 (2) dt.10-08-2017 2/2 Having heard both sides and in view of the fact that daughter of the informant stated about this petitioner in her statement, I do not find it to be a fit case for grant of anticipatory bail. However, petitioner may surrender before the Court below within a period of four weeks and make prayer for regular bail, which will be considered and disposed of on its own merit without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed.
