The petitioner apprehends his arrest in connection with Complaint Case No. 369 (C) of 2014 for the offences punishable under sections 420, 468 and 504 of the Indian Penal Code.
Mr. S.P. Parasar, learned counsel for the petitioner with reference to the petition of complaint present at Annexure-1 submits that a civil dispute has been given a colour of criminal litigation. With reference thereto it is submitted that the petitioner has been charged with illegal transaction of the plot belonging to the complainant. He submits that the dispute involves adjudication on title.
Having heard learned counsel for the parties and considering the nature of allegation set out in the complaint, let
Patna High Court Cr.Misc. No.52843 of 2015 (2) dt.14-12-2015 the petitioner, namely, Sitaram Singh in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui and/or the court concerned in connection with Complaint Case No. 369(C) of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
