JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2019 This is an application for grant of anticipatory bail in connection with Jamui Adarsh P.S. Case No. 676 of 2018, disclosing offences under Section 272 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation of recovery of 25 liters of illicit liquor from the Tempo of the petitioner.
Submission of the learned counsel for the petitioner is that petitioner is owner of the said Tempo and he has given to the driver for running and paying him the daily rent and the F.I.R. itself shows that somebody kept the liquor in his tempo. Further submission is that petitioner has no criminal antecedent. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,

No.30701 of 2019(3) dt.24-07-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge, 2nd, Jamui, in connection with Jamui Adarsh P.S.
