This is an application for grant of anticipatory bail in connection with Bhagwanpur Hat P.S. Case No.264 of 2022, registered for offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Though meagre quantity of 15 litres of illicit liquor has been recovered from the shop of the petitioner, however considering the bar under Section 76(2) of the Bihar Prohibition and Excise Act, 2016, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to surrender before the learned trial court and seek regular bail, however, seeks a direction upon the
Patna High Court CR. MISC. No.26618 of 2023(2) dt.07-07-2023 2/2 learned trial court to consider and dispose off the petition, to be filed by the petitioner, for grant of regular bail on the very same day.
Having regard to the facts and circumstances of the case, I deem it fit and proper to grant liberty to the petitioner to surrender before the learned Court of Exclusive Special Excise Court No.1, Siwan in connection with Bhagwanpur Hat P.S. Case No.264 of 2022, within a period of six weeks from today, and file a petition for grant of regular bail, which is directed to be considered and disposed off on the very same day, specially taking into consideration the fact that meagre quantity of 15 litres illicit liquor was recovered from his shop.
The petition stands disposed off as not pressed, however with the aforesaid liberty and directions.
