JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-06-2018 The petitioner has preferred the present writ petition for quashing of the office order dated 31.08.2010 passed by the Joint Secretary to the Government Building Construction Department, Bihar, Patna whereby and whereunder, the case of the petitioner for grant of half pay for the period of study leave has been rejected.
The learned counsel for the respondents submits that since the petitioner had not completed five years of service, he was granted study leave without pay under Rule 204 of Bihar
Patna High Court CWJC No.17937 of 2010 (2) dt.20-06-2018 2/2 Service Code.
In such view of the matter, there is no merit in the plea of the petitioner for grant of half pay for the period of study leave.
For the reasons mentioned hereinabove, there is no merit in the present petition, accordingly the same is dismissed. (Mohit Kumar Shah, J) rinkee/- U
