2. The petitioner apprehends his arrest in connection with Bhairav Asthan P.S. Case No. 20 of 2023 registered for the offence punishable under Sections-379 & 461 of the Indian Penal Code.

3. According to allegation, after cutting the shutter of the godown, unknown thieves committed theft of the iron Sariya worth Rs. 7,00,000/ (Rs. Seven lacs).

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. Nothing was recovered from his possession and except the confessional statement of co-accused, there is

5. Learned counsel appearing for the State has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, let the petitioners named above, in the event of arrest/surrender within four weeks before the court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in connection with Bhairav Asthan P.S. Case No. 20 of 2023 subject to the conditions as laid down u/S 438(2) of the Cr.P.C. /482(2) of BNSS, 2023.

7. After accepting the bail bond, the criminal antecedent of the petitioner be verified and if it is found that the petitioner is involved in any other case except the present one, learned counsel below shall be at liberty to cancel the bail bond of the petitioner.
