JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-07-2025 Heard learned counsel appearing on behalf of the petitioner, learned APP appearing on behalf of the State and learned counsel appearing on behalf of Opposite Party No. 2.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.
3. As per prosecution case, this petitioner is alleged to have obtained appointment on the post of "Panchayat Teacher" on the basis of forged and fabricated certificate.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has

Petitioner was appointed as Panchayat Teacher after investigation of all his certificates by the concerned department, but later on, same have been declared as forged and fabricated without proper verification or giving any notice to the petitioner. Moreover, the petitioner has already resigned from his service vide letter dated 01.04.2025 (Annexure-P/2 to this petition). Petitioner claims clean antecedents.
5. Learned A.P.P. for the State and learned counsel appearing on behalf of the Vigilance have vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation, the fact that petitioner has already resigned from his services and clean antecedents, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran at Motihari in connection with Kalyanpur P.S. Case No. 323 of 2024, subject to condition as laid down under
