====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 06-01-2022 Heard Mr. Amrendra Kumar, learned counsel for the petitioner and Md. Shakir Ahmad, learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner seeks regular bail in connection with Sikandara P.S. Case No. 283 of 2020 registered for the offence punishable under Sections 302/34 of the Indian Penal Code 1860 and Section 27 of the Arms Act. As per First Information Report, a scuffle took place between the side of petitioner and the informant and in the said quarrel, on the order of co-accused Ramdas Yadav, his son, namely, Ranjeet Yadav fired upon the chest of the deceased, Pravin Kumar.

No.36294 of 2021(2) dt.06-01-2022 2/3 Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. Learned counsel further submits that there is no allegation of firing upon the deceased, against the petitioner. The petitioner was only the member of the mob. He next submits that co-accused Ramdas Yadav who was order giver, has been granted bail by this Court in Cr. Misc. 33756 of 2021. The petitioner is in custody since 4.1.2021 having no criminal antecedent.
Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner has got no criminal antecedent, he is in custody since 4.1.2021 and other coaccused person Ramdas Yadav has been granted bail by this Court, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui, in connection with Sikandara

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
