JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-06-2018 The petitioner had earlier also approached this Court by filing a writ petition bearing C.W.J.C. No. 17468 of 2009 and this Court by an order dated 19.02.2010 had directed the petitioner to represent before the authorities for grant of suitable relaxation in age, however the said earlier writ petition was dismissed as withdrawn.

The learned counsel for the respondents, referring to paragraph no. 14 of the counter affidavit has submitted that the Department has not received any representation from the petitioner till date.

In view of the aforesaid, I find that the present writ petition is not only barred by principles of res judicata and

Patna High Court CWJC No.18344 of 2010 (2) dt.22-06-2018 2/2 constructive res judicata but the petitioner is also guilty of abuse of the process of the Court inasmuch as without complying with the earlier order dated 19.2.2010, passed by this Court in the case of the petitioner himself, the petitioner has approached this Court brazenly.

The writ petition is dismissed.
