JUSTICE SUDHIR SINGH ORAL ORDER 13-01-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 420, 467, 468/34 of the Indian Penal Code.

Allegation against the petitioner is that he has received Rs.2,000/-, which had been sent through Money Order in favour of the informant, but not delivered to him (informant). It is submitted on behalf of the petitioner that he has got no criminal antecedent. As per prosecution case, Rs.2000/- was sent in the name of the informant and same was not delivered by the petitioner, who happens to be the Post Master of the Branch Bhadokhra Post Office. After investigation the police has submitted final form in the present case so far as petitioner is concerned, which is evident from Annexure-2 to the present application.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.52840 of 2015 (2) dt.13-01-2016 2 / 2 Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri K; L. Yadav, learned Judicial Magistrate, 1st Class, Nawada, in connection with Mufassil P.S. Case no. 109 of 2007, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
