The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 307, 379 and 324 of the Indian Penal Code, Section 27 of the Arms Act and Sections 3/4 of the Explosive Substance Act.

Allegedly, it is a case of assault and throwing of bomb and opening fire causing injuries to the informant side. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that specific allegation of throwing the bomb is against co-accused Billu Chaudhary. Co-accused Vikash Chaudhary, Saurav Paswan and Mogal Chaudhary are alleged to

Patna High Court CR. MISC. No.26636 of 2022(2) dt.12-10-2022 2/2 have opened fire causing injuries to the informant and his family members. He further submits that there is no specific overt-act of assault against this petitioner. Petitioner has clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Nawada (Town) P.S. Case No. 819 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
