2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Paraiya P.S.Case No. 295 of 2022.

3. As per allegation, the petitioner fired shot at the informant. He did not suffer any injury, but due to firing his right ear became numb.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no injury at all on the person of the informant. He has also submitted that the petitioner is in custody since 17.08.2023.

5. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the

No.29124 of 2024(3) dt.05-07-2024 2/2 like amount each to the satisfaction of learned ACJM-3rd, Gaya, in connection with Paraiya P.S.Case No. 295 of 2022, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

6. This case has been heard out of turn on the mentioning slip filed by the petitioner, annexing therewith the invitation card/wedding card regarding marriage of the petitioner's sister, namely, Kumari Bindi Yadav, showing her marriage to be solemnized on 12th of July, 2024.

7. The Sr. Superintendent of Police, Gaya, is directed to verify the said fact as to whether the marriage of the sister of the petitioner is to be solemnized on the said date or not, and a report in this respect must reach this Court within a period of four weeks.

8. List the matter on 01.08.2024.
