The petitioner apprehends his arrest in Lalganj P.S. Case No. 166/2015, registered for the offences punishable under Section 308 and other Sections of the Indian Penal Code. The informant alleged that the petitioner and others were forcibly cultivating his lands by virtue of sale deed executed by his brother. When the informant objected, the petitioner is said to have assaulted the informant with iron rod on his head. Other accused persons are also alleged to have assaulted the informant. Learned counsel for the petitioner submits that the petitioner has purchased the land but the informant tried to dispossess the petitioner. The injury is found on the person of the informant is simple in nature.

No.48293 of 2016 (3) dt.10-01-2017 2/2 Considering the facts aforesaid and the fact that on account of land dispute scuffle took place between both sides and the informant got simple injury, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 166/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
