JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 23-06-2023 The petitioner in the present case is seeking a direction to the respondents to release the security deposit amount of Rs.5,50,000/- in favour of the petitioner with bank interest which the petitioner claims to have deposited for affiliation of BCA, BBM and BLIS programme of Magadh University, Bodh Gaya.

Learned counsel for the petitioner submits that after the security deposits were made, the matter relating to affiliation of the institution remained pending with Magadh University. In the meantime, Patliputra University came into existence and because the petitioner college fell under the Patliputra University, he applied for the same with Patliputra University and got affiliation. Learned counsel for the petitioner submits

Patna High Court CWJC No.7303 of 2023(2) dt.23-06-2023 2/2 that in such circumstance, the petitioner deserves refund of his security deposit. He has made a request to the Registrar of Magadh University (respondent no. 3) vide Annexure '5' to the writ application.

Learned counsel for the University is present. In the kind of reliefs prayed in this writ application, this Court directs the Registrar, Magadh University, Bodh Gaya to look into the request of the petitioner as contained in Annexure '5' to the writ application and take appropriate view on the same within a period of two months from the date of receipt/production of a copy of this Court.

If the respondent no. 3 finds that the security deposit is liable to be refunded to the petitioner, the same will be done within a further period of two months.
