Petitioner is apprehending his arrest in Buxar (T) P.S.Case No.565 of 2017 registered for the offences under Sections 406, 420, 457, 468, 471.34 of I.P.C. Allegation against the petitioner is of collecting the money from the customers under the said scheme. However, he has refused to return back the money.

Submission of the learned counsel for the petitioner is that there is no receipt of taken money by the petitioner and he is himself collecting Agent and also in the bank. He has made complaint against the Managing Director and other officials of the

Patna High Court Cr.Misc. No.3837 of 2018 (3) dt.01-02-2018 2/2 Bank.

Heard learned counsel for the bank also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner. However, if the petitioner surrenders before the court below and prays for grant of provisional bail to the petitioner and on his so surrendering, the learned court below shall consider the prayer for bail on its own merit without being prejudice by this order.

With the aforesaid observation, this application is dismissed.
