1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 354 and 504/34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and has been falsely implicated in the instant case by the informant with an allegation that petitioner assaulted the informant by rod causing injury on his head. It is further submitted that the occurrence took place on account of dispute relating to land.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that though the injury report has been annexed with the anticipatory bail application as Annexure-2 but then the same does not record the
Patna High Court CR. MISC. No.29232 of 2024(3) dt.26-06-2024 2/2 nature of injury on which learned counsel appearing on behalf of the petitioner submits that the injured suffered simple injury.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with G.R. No. 367 of 2024 arising out of Sandesh P.S. Case No. 10 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
6. However, the learned trial court before accepting the bail bonds of the petitioner shall verify the injury report of the injured and if it is found that the injured has suffered grievous injury on his head in that event the present anticipatory bail order shall not be given effect to.
