ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 13.02.2019 in connection with Kalyanpur P.S. Case No. 31 of 2019 registered for the offence under Sections 272, 272, 414 of the Indian Penal Code and Sections 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were made from an abandoned place and not from the motorcycle as alleged and the same blame has been saddled on the shoulder of the petitioner and the petitioner is nothing to do with the said article.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.25256 of 2019(2) dt.19-04-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge-cum-Special Judge, Excise, East Champaran, Motihari, in connection with Kalyanpur P.S. Case No. 31 of 2019.
