Petitioner seeks regular bail in connection with Sangrampur PS Case No. 50/2020 registered for the offence punishable under Sections 30(a), 32, 41(i) of Bihar Prohibition & Excise Act 2016.

The allegation against the petitioner as per First Information Report is that the police intercepted the motorcycle borne by the petitioner along with other two accused persons and recovered 45 litres of illicit liquor.

Learned counsel for the petitioner submits that the petitioner has not committed offence in the manner alleged and he has falsely been implicated in this case. Learned counsel

No.24364 of 2020(2) dt.21-09-2020 2/2 referring to para-8 of the instant petition, submits that petitioner is not the owner of the motorcycle in question and he is under custody since 11.03.2020. Learned counsel also submits that petitioner has got no criminal antecedents.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 11.03.2020 having not criminal antecedents, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, RAM KISHORE RAM be released on bail, if he is not required in any other case, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IX-cum-Special Judge, Excise, East Champaran, Motihari in connection with Sangrampur PS Case No. 50/2020.

It is made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding lockdown and social distancing.
