The petitioner seeks bail in Daudpur Police Station Case No. 93 of 2020 registered for the offence punishable under sections 307/379 and other ancillary sections of the Indian Penal Code.

Prosecution's case, in brief, is that on 15.5.2020 at about 8 am petitioner along with other accused persons, named in the FIR, armed with lathi, danda etc. came to the house of the informant and started hurling abuses and on protest they assaulted the informant with fists and slaps. They also assaulted her son with lathi, danda, etc when he tried to save his mother. One Bansi Devi was also assaulted by the accused persons. The petitioner stabbed informant's son and snatched Jitiya and Tops from her possession.

Learned counsel for the petitioner submits that the petitioner is next door Gotiya and there was some land dispute pending between the parties and informant and her inmates also

Patna High Court CR. MISC. No.24224 of 2020(3) dt.04-11-2020 2/2 assaulted the petitioner's family for which Daudpur Police Station Case No. 92/2020 has been registered and the present case is counter blast of that case. Petitioner has got no criminal antecedent and he is in custody since 12.5.2020. Learned counsel for the State opposes the prayer for bail and submits that as per the FIR, the petitioner caused incised injury in belly of informant's son.

In the facts of the case as well as considering the nature of allegation, prayer for bail of the petitioner is refused. (Prabhat Kumar Singh, J) Shashi U T
