The petitioner apprehends his arrest in Amba P.S. Case No. 55/2016, registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

The petitioner being the Chairman of Parta Packs falling within Kutumba Block purchased 2635 quintals of paddy in the financial year 2015-16. He deposited 1028.45 quintals of C.M.R. to the B.S.F.C. and only 737 quintals of C.M.R. remained lying due against the petitioner. Petitioner is ready to deposit Rs. 16,84,782/- by 15.02.2017 which is the cost of 737 quintals of C.M.R.

Mr. Shailendra Kumar Singh learned counsel for the

Patna High Court Cr.Misc. No.45983 of 2016 (3) dt.01-12-2016 2/2 B.S.F.C. submits that he has got not objection if the entire money is paid to the B.S.F.C. by 15.02.2017.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Amba P.S. Case No. 55/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. If the petitioner fails to deposit Rs. 16,84, 782/- by 15.02.2017, learned court below shall cancel the bail bond of the petitioner on 16.02.2017.
