The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 341, 323, 324, 448, 379, 504, 506 and 34 of the Indian Penal Code. As per the prosecution case, the petitioner is said to have given a farsa blow on the neck of the son of the informant, however on the informant's son saving himself, the blow hit on his stomach.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The manner of occurrence is other than what has been narrated in the FIR. The injury report has been obtained from the hospital in Nepal. The petitioner is in custody since 6.12.2021 and he has no criminal antecedent

Having heard learned counsel for the parties and taking into consideration the nature of allegation together with the petitioner having remained in custody for more than 1 year since 6.12.2021 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Balua Bazar P.S. Case no. 55 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate I, Supaul.
