JUSTICE ARVIND SRIVASTAVA ORAL ORDER 30-08-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Dhanarua P.S. Case No. 237 of 2016 registered for the offence punishable under sections 328, 302 of the Indian Penal Code. Learned counsels appearing for the petitioner submits that at the relevant time the deceased was at Naihar and petitioner was not present there. Petitioner or his family members were not informed about the death of the deceased. As a matter of fact, deceased had some quarrel with her mother and in anger she committed suicide.

Learned counsel appearing for the informant opposes the prayer for bail and submits that there is specific allegation of giving two tablets to the deceased which the deceased consumed and succumbed to death. During investigation witnesses have

Considering the nature of allegations levelled against this petitioner and the rival submissions of the parties, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner.
