This is a petition for grant of anticipatory bail for offence under Sections 399, 402, 307 and 353 of the Indian Penal Code and 25(1-b)a, 26, 27 and 35 of the Arms Act. Allegation is that the mob of the miscreants had assembled to commit crime. Petitioner is not named in the first information report and his name appeared in the confessional statement of the co-accused.

The petitioner has stated on oath that he has got no criminal antecedent.

Considering the aforesaid fact that there is no substantial material against the petitioner, above named, he, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Manjhagarh P.S. Case No. 31 of 2016 to the satisfaction of the Chief Judicial Magistrate, Gopalganj, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
