JUSTICE MOHIT KUMAR SHAH ORAL JUDGMENT Date: 12-07-2018 As far as the due salary for the month of February and December, 2009 is concerned, the stand of the respondents in paragraph no. 8 of the counter affidavit is that the same has not been paid on account of non-submission of the statement of income for the Financial Year 2008-09 and 2009-10 so as to assess the income tax to be deducted at source.
Having regard to the facts and circumstances of the case, I direct the respondents to pay the due salary for the period February and December, 2009 after deducting T.D.S. within a period of four weeks from today.
Patna High Court CWJC No.19637 of 2010 dt.12-07-2018 2/2 As far as the due salary for the period 15.01.2010 to 31.05.2010 is concerned, the petitioner, if so advised, may file a representation before the respondent no. 4 within a period of two weeks from today and the respondent no. 4 shall take a final decision by a reasoned and speaking order within a period of four weeks thereafter.
The writ petition is disposed of on the aforesaid terms.
