1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The learned counsel for the petitioner submits that the present application has been filed seeking quashing of the order dated 26.03.2014 passed by Smt. Indrani Kisku, learned Judicial Magistrate 1st Class, Patna in Shashtri Nagar P.S. Case No. 187 of 2008 by which the learned Judicial Magistrate 1st Class, Patna has been pleased to take cognizance for offences punishable under Section 304(A) of the Indian Penal Code.

3. Learned counsel for the petitioners very fairly submits that after cognizance much water has flown and the trial has commenced, thus seeks permission to withdraw the present

Patna High Court CR. MISC. No.53027 of 2015(2) dt.30-08-2023 2/2 quashing application with liberty to raise all the issues in the trial.
