JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-07-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 399 of 2022, registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per allegation, when the informant along with his father was returning to their house, 11 named accused persons started abusing them. They caught hold the father of the informant. The further allegation is that co-accused Md. Arman, Md. Irfan @ Chhotu and co-accused Md. Khursheed forcibly dragged his father to the northern direction and Md. Khursheed fired shot at the temporal region on his father, resulting into his death.

Patna High Court CR. MISC. No.26647 of 2023(2) dt.12-07-2023 2/2 The learned counsel for the petitioner has submitted that the specific allegation of opening fire on father of the informant is on Md. Khursheed and the specific allegation of catching hold the deceased is against Md. Arman and Md. Irfan. The entire family members and relatives have falsely been made accused in this case. The petitioners are the persons of clean antecedent.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Muffasil P.S. Case No. 399 of 2022, subject to condition as laid down under section 438(2) Cr. P.C.

Further condition is that the petitioner shall remain present physically on each and every date before the court below till framing of the charges.
