Mr.Ram Priya Sharan Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-08-2025 Heard learned counsel for the petitioners (in both cases) and learned A.P.Ps. for the State.

2. The petitioners seek bail in a case registered for offence under Sections 399, 402, 120(B), 34 of the Indian Penal Code, Sections 25(1-AA), 25(1-A), 25(1)(d), 26, 35 of the Arms

Patna High Court CR. MISC. No.25253 of 2025(3) dt.29-08-2025 2/3 Act and Sections 20(B)(ii)(c), 23(c) and 29 of N.D.P.S. Act.

3. The police, on a tip off, conducted raid and apprehended three persons on the spot with arms and ammunition, who disclosed the name of petitioners and other co-accused persons.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence and have been falsely implicated in this case. No incriminating article has been recovered from possession of these petitioners. Petitioner namely Vikki Kumar @ Vikky Thakur (in Cr.Misc. No. 25253/25) is in custody since 08.02.2025, whereas petitioner namely Aman Kumar @ Aman Ram (in Cr.Misc. No. 26624/25) is in custody since 18.02.2025. Chargesheet has been submitted. Other similarly situated co-accused persons have already been granted bail by a coordinate Bench of this Court (copy of orders are annexed at Annexures 2 to 5 to the bail petition).

5. Learned A.P.P. for the State opposed the bail petitions.

6. Considering the aforesaid facts and circumstances, let the above named petitioner in both cases namely Vikki Kumar @ Vikky Thakur and Aman Kumar @ Aman Ram be

No.25253 of 2025(3) dt.29-08-2025 3/3 released on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge-II, NDPS Act, East Champaran, Motihari / concerned Court in connection with Motihari Town P.S. Case No. 306 of 2024 with following conditions:

"(i) One of the bailors shall be close relative of the petitioner(s).

(ii) Petitioners shall cooperate in the trial and shall remain physically present on each and every date, as fixed by the Court and on his absence on two consecutive dates, without prior permission/sufficient reason, their bail-bonds shall liable to be cancelled by the Court below."
