The petitioner seeks pre-arrest bail in connection with Sessions Trial No. 2483 of 2015 arising out of Thakraha (Bhitaha) P.S. Case No. 132 of 2014 registered under Sections 7 of the Essential Commodities Act.

It is contended that though there is allegation that inspection was done by the Anchaladhikari-cum-Block Supply Officer, Bhitaha and the Executive Magistrate and, during inspection, consumers submitted written statement/complaint before them about non-receipt of ration in the month of April, but written complaints submitted by the consumers attached to

Patna High Court Cr.Misc. No.54676 of 2015 (2) dt.09-12-2015 2 / 2 the shop of the petitioner has not been made a part of the FIR. It has been further contended that the petitioner has got roots in the society and is not likely to abscond or tamper with the prosecution evidence.

Learned counsel for the State has opposed the application for anticipatory bail. He has submitted that the allegation against the petitioner is that despite receipt of ration for the month of April, 2014, the petitioner did not distribute the same to the consumers.

Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, West Champaran at Bettiah in connection with Thakraha (Bhitaha) P.S. Case No. 132 of 2014 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
