JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-04-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek pre-arrest bail in connection with Dehri (Dalmia Nagar) P. S. Case No. 425 of 2017 registered under Sections 341, 323, 307, 325, 379, 506 read with 34 of the Indian Penal Code.
Considering the submission that there is case and counter case and the accused persons in the counter case have already been granted pre-arrest bail vide order dated 19.08.2017
Patna High Court Cr.Misc. No.18197 of 2018 (2) dt.05-04-2018 2/2 passed in Cr. Misc. No. 38108 of 2017 as also the submission that save and except one injury all the injuries sustained by the members of the prosecution party were simple and superficial in nature, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Dehri, Rohtas in Dehri (Dalmia Nagar) P. S. Case No. 425 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
