JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 22-04-2019 This application under Article 226 of the Constitution of India has been filed by the petitioner for directing the respondents to provide security to the petitioner and his family members.

Learned counsel for the petitioner submitted that the life of the petitioner and his family members is in grave danger at the hands of the respondent nos. 7 to 10. He contended that in this regard he has informed the police, but the police are taking

Patna High Court CR. WJC No.667 of 2019(2) dt.22-04-2019 2/2 no action against the respondent no. 7 to 10. Learned counsel for the State submitted that the State Government has taken a resolution whereby District Level Security Committee has been constituted in each of the districts of the State of Bihar. He submitted that for the relief prayed for in the present application, the petitioner should first approach the District Level Security Committee.

The threat perception to the life of the petitioner or his family members cannot be assessed by this Court. Such perception has to be first assessed by the respondent authorities. Since the State Government has already constituted a District Level Security Committee the petitioner may approach the Committee first for the redressal of his grievance. In case, such a representation is filed, the concerned District Level Security Committee shall be required to look into the representation and pass necessary orders in accordance with law. With the aforesaid observation and direction, the application is disposed of.
