In this case, the petitioner is apprehending his arrest in connection with Yogapatti P.S. Case No. 226 of 2017 registered for offences under sections 341, 323, 504, 447, 506 of the Indian Penal Code.

An allegation has been against the petitioner of forcibly removing the hut of the Informant and filling soil in order to construct his house.

It appears that earlier the Informant had approached to the Janata Darbar and, on that basis, a case was instituted in which the petitioner was granted bail and, later on, the present case has been lodged against the petitioner.

Learned counsel for the petitioner has drawn attention of this Court towards the settlement of the said land which is Annexure-2 and also produced the photocopy of the rent receipt

Patna High Court CR. MISC. No.23693 of 2019(2) dt.12-04-2019 2/2 showing the possession of the land as well as in paragraph no.7, a statement has been made that there is a title and possession dispute which has been settled in Case No. 94 of 2001 and Jamabandi No. 980 was created in the name of the Ram Kishun Prasad. Looking to the entire facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, Dist.West Champaran in connection with Yogapatti P.S. Case No. 226 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.

C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled. Let the photocopy of the rent receipt produced today be kept in the record for its future reference.
