As per allegation in the F.I.R., it is stated that 230 grams of charas was recovered from the motorcycle of the petitioner.

It is submitted by learned counsel for the petitioner that no recovery, as alleged, has taken place and there has been violation of section 50 of the NDPS Act. Petitioner has falsely been implicated in the present case only because he has criminal antecedent. Petitioner is in custody since 24.02.2020 and undertakes to cooperate in the trial.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.27719 of 2020(4) dt.24-02-2021 2/2 taking into consideration the petitioner being in custody since 24.02.2020, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Rajapakar P.S. Case no. 37 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge-cum-Special Judge, Hajipur, Vaishali.
