JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-06-2023 The present writ petition has been filed seeking the following relief:- "1(a) That this is an application to issue a writ in the nature of mandamus to direct the respondents concerned to conclude the appointment process of the petitioner and others to the post of Secretary of Gram Katchhari, Barkagaon, Block-Pakridayal DistrictEast Champaran after following the proper procedure of law, which is

The learned counsel appearing for the respondent-State has referred to the counter affidavit filed in the present case to submit that the selection process in question has already come to an end in the year 2011, hence the panel prepared has also expired, thus the present writ petition has been rendered infructuous. It is also submitted that the District Gram Katchahry Secretary (Employment, Service Conditions and Duties) Rules, 2007 have been repealed vide notification dated 05.01.2015 and now new Rules, 2014 have come into force, wherein the minimum eligibility for selection has been prescribed as intermediate pass, however, the petitioner is matriculate, hence on this ground as well the petitioner has got no case for being appointed on the post of Secretary, Gram Kachahari, Barkagaon Block- Pakridayal, District-East Champaran.

Having regard to the facts and circumstances of the case, I do not find any merit in the present writ petition, hence the present writ
